Concern: Ambiguous & Vague Language
Ambiguous and vague language granting the government more power does not work in favor of citizens.
Such language can be twisted by regulatory agencies and later be challenged by special interest groups, creating a legal mess. Then judges—not our elected officials—make the final decisions with enormous implications for private property owners and their rights.
For example, in this draft, the word “Encourage” is used 43 times, “Promote” is used 38 times, “Support” is used 22 times, and “Guide” is used 10 times. There can be many different meanings to these words. These words are a clever way to avoid having to use words which would more accurately describe what’s meant, like “Require” or “Force” citizens to do what they otherwise would not do? Unfortunately, this has been the history of governments at all levels.
Language in the County’s new General Plan needs to be clear and easy to interpret.
